Shenzhen CoolKit Technology CO., LTD (“We” or “CoolKit”) understands the importance of your personal information, so we will take appropriate measures to protect your personal data. This Privacy Policy (“Policy”) describes how and why we collect, receive, use, store, transfer and process your personal information, as well as your rights in determining how we handle your personal information that we collect or hold about you when you use our websites, our cloud-based loT platform (“eWeLink”) and other services (collectively, "Services"). In our Services, you can adjust your privacy settings to decide which categories of data we may collect and how it is used, which is elaborated in detail in the following provisions.

 

This Policy does not apply to the information processing practices of other companies and organizations that advertise our Services or place links on our websites, apps or other platforms. We encourage you to review the privacy policies of these third-party websites, apps or other services.

 

We encourage you to read this Policy carefully before using our Services. You are not obliged to provide us with your personal data. However, if you choose not to provide certain Personal Data, some features may not function properly or to achieve their intended purposes.

 

  1. Definition

 

Personal Data” or “Personal Information” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. This definition is in accordance with General Data Protection Regulation (“GDPR”).

 

User Data” means the data submitted by the users or collected by us for the purpose of providing our Services, such as user name, contact information, location, etc., when users register for an account on our website, software, or other service platforms and use corresponding functions. For further clarification, User Data may include Personal Data as well as non-personal data generated during use.

 

Smart Device” refers to any devices capable of transmitting data wirelessly over a network including smart home appliances, etc.

 

  1. Information We Collect

 

In order to provide our Services to you, eWeLink will receive or collect information when we operate and provide our Services. The information we collect and how this information will be used depends on how you use our Services and the choices you make (including your privacy settings).

 

We hope to provide perfect products and Services. Therefore, we will continue to improve our products and Services, which means that with their iteration, expansion and upgrade, we may update or improve existing features and may require the collection of new Personal Data or change the purpose or method of using Personal Data.

 

Please note that if we use your Personal Data for other purposes not described in this Policy, or if we collect additional Personal Data not mentioned here, we will obtain your consent through pop-up, page prompts, interactive communications, website announcements or other means. Once we have obtained your consent, we will only process such data for the purposes you have consented to. And this Policy shall also apply to such additional data or information. If you have any questions in this process, you may contact us using the details provided in the “How to Contact Us” section of this Policy and we will respond as soon as possible.

 

  • Information You Create or Provide to Us

 

  • Account Information:

 

When you register an account with our eWeLink products and log in, we may collect your country code, email address and password. When you are interacting with us, we may further collect the nickname, profile, language preference and time zone in your account.

 

However, when you would like to continue as a guest without registering or logging (“Try It Now Mode”), we will not collect your account information, including your email address and password. You may still use core eWeLink features without creating an account, including searching or browsing any features related to the Services, adding and controlling devices, setting scenes, by creating a guest ID.

 

  • Data of Smart Device Control Scenarios:

 

You may customize Smart Device control scenarios during the use of our Services. We will collect the data related to such scenarios, including the data of your personalized home scenarios (home ID, name, list of rooms), room scenarios (room ID, name, sorting), and your manual scene data (scene name, operation list, operation type, associated execution devices). The purpose of collecting the above data is to realize the control of your Smart Devices, that is, when the conditions set in the scenarios are met, the Smart Devices will perform the corresponding actions.

 

  • Feedback:

 

When you submit feedback to get customer support for our Services, you will provide information related to your use of our Services, including your email address, and your feedback content (i.e. the issue descriptions, log files which you can choose whether to upload for better troubleshooting the cause of your reported issues), so we can provide you with customer support.

 

  • Information We Collect as You Use Our Services

 

  • Mobile Device Information:

 

When you install, access, or use our Services, we collect device-specific information, including the identifier For Vendor (IDFV) (applicable to IOS users), Android ID (applicable to Android users), device status, IP address, wireless connection information, operating system type and version, application version number, push notification identifier, log files, and mobile network information, to ensure your account safety and the proper use of our Services.

 

  • Usage and Log Information:

 

Through your usage of eWeLink Services, we collect the information about your interactions with our website and Services, including diagnosis records, log files, crash reports, website visits, clicks, downloads, in order to analyze the usage of relevant functions and perform analytic to improve performance and user experience.

 

  • Specified Application Installation Status:

 

When you choose to use the function associated with third-party smart home applications, we will collect the installation status of selected third-party applications to enable interoperability and allow account linking when you choose to do so.

 

Please note that such information alone generally does not directly identify an individual unless combined with other identifiers. If we use the above information in combination with other Personal Information to identify a specific natural person or in combination with information that can identify a natural person, we will anonymize and de-identify such personal information when using such information, unless we obtain your authorization or otherwise it is required by laws and regulations.

 

  • Location Information:

 

We will collect the approximate or precise location information from you when you enable location-based functions and use related Services, including discovering and adding a Smart Device, using geofencing functions, obtaining the local weather information, setting trigger conditions (i.e. sunrise and/or sunset) for Smart Device control scenarios. Hereinto, precise location information (including country and region, longitude and latitude, time zone) is required for the first two aforementioned functions. You can restrict individual apps’ access to location information at any time in your phone Settings > Apps > Permissions > Location.

 

  • Camera Information:

 

The camera information we collect will be used to allow you to scan the QR code for connecting to the Smart Devices or capture videos when you choose to do so. This information may include the QR code information and Smart Devices’ name, model, and firmware version. You can restrict individual apps’ access to camera information at any time in your phone Settings > Apps > Permissions > Camera.

 

  • External Camera Information:

 

  • When you add an external camera device to eWeLink, you can view the real-time video at any time through eWeLink services. For this purpose, we may collect the current video time, network speed, video quality selection.We do not access or store image or video content unless you manually enable the recording feature for the current real-time video.

 

  • You can also have conversations through the video intercom function of the external camera device. We do not access, store, or transmit audio contentunless you enable recording the current real-time video before or during the use of the video intercom

 

  • We also provide a camera plan for you. When you subscribe to this plan, you can use the functions of recording, cloud storage, replay, and alert notifications. For this purpose, we may further collect the recording metadata (time, duration) and recorded video content, which may include identifiable images, movements, surrounding, and audio(images of individuals’ faces, movements, surroundings, and sound), alert triggering event. The period of the video cloud storage is thirty-one [31] days.

 

The functions of recording, cloud storage, replay, and alert notifications are set to be disabled by default and you need to turn them on manually and separately following the approaches as below:

 

  • Camera Detail Screen > Record, for enabling the function of recording real-time videos;

 

  • Devices Settings > Motion Detection, for enabling the function of cloud storage;

 

  • Devices Settings > Local Recording > Save To Micro SD Card, for enabling the function of local recording;

 

  • Motion Detection Devices Settings > Motion Detection > Push Notifications, for enabling the function of alert notifications.

 

After activation, if you no longer wish to use the related functions, you can disable them following the same approaches as their enabling.

 

We encourage you to comply with the local legal requirements for privacy and personal data protection when you install and use the device or download and share the images or videos. Otherwise, you shall bear the responsibilities independently in case of any violations of applicable laws. Your information will be stored on secure servers, and we process such information only for the purposes you have enabled or consented to, where required. If we need to use the information for other purposes, we will seek your consent again.

 

  • Access to the Album:

 

You may upload pictures or videos to submit user feedback. For this purpose, we will collect the images or videos solely to resolve your feedback request. You can restrict individual apps’ access to the album at any time in your phone Settings > Apps > Permissions > Album.

 

  • Using the Microphone:

 

You can use the microphone to achieve voice functions. For this purpose, we process audio input only when you initiate a voice command to recognize and execute that command. Please note that even if you have agreed to enable the microphone permission, we will only obtain your voice information when you actively click the microphone button or record a video in eWeLink.

 

  • Bluetooth Permission:

 

When you enable the Bluetooth permission, we will collect your Bluetooth information and use it for communication in these scenarios:

 

  • Displaying Smart Device status on eWeLink’s APP, device paneland dashboards.

 

  • Controlling Smart Devices on eWeLink’s APP, device paneland dashboards.

 

  • Discovering Smart Devices and configuring Smart Devices’ networks on eWeLink’s APPand device adding page.

 

You can disable the Bluetooth function at any time in your phone Settings > Apps > Permissions > Bluetooth.

 

  • Information Related to Smart Devices:

 

  • Basic Information of Smart Devices: When you connect your Smart Devices with our Services, we may collect basic information about your Smart Devices including device name, device ID, online status, activation time, firmware version, and upgrade information.

 

  • Information Collected during the Connection of Smart Devices: This information may include Wi-Fi identifiers(SSID, BSSID) and encrypted credentials used only temporarily for connecting to the Smart Devices. We do not store Wi-Fi passwords, Smart Devices’ MAC addresses, and Smart Device ID in the cloud.

 

  • Information Reported by Smart Devices: When you use Smart Devices, we may collect theoperational data generated by the Smart Device when executing your commands.

 

  • Information from Third-party Sources

 

In some scenarios, and as permitted by law, we may obtain your Personal Data from a third party, including:

 

  • When you subscribe to our subscriptionplan or other paid services, in order to confirm your order status and provide services accordingly, we may collect your purchase order information from Apple, Google Play or other platforms depending on your payment methods. This information includes your order number, the total of your payment amounts, payment time, service period;

 

  • When you connect your eWeLink account with a third-party account to control the Smart Devices with voice command via the third-party’s speaker device connected to that third-party account, onlythe data strictly necessary to enable the voice-control feature is exchanged between eWeLink’s and the third party’s platforms. After receiving the relevant data, eWeLink will only store the log data with a retaining period of thirty [30] days, and the operation record data extracted from the log data with a retaining period of ninety [90] days;

 

  • You may authorize a third party to transfer data to us.

 

  1. Cookies and Similar Tracking Technologies

 

When you visit our website and Services, we and service providers on our behalf may send one or more cookies, which are small data files (“Cookie”), to your devices to uniquely identify your browser and let us help you to facilitate sign-in and improve navigation efficiency through the Sites. We use Cookies for several purposes, depending on the context or Services, including:

 

  • Storing your preferences and settings: We use Cookies to store your preferences and settings on your device. If you enter your location to get local weather information based on our Services, we store the data in a Cookie so that you will still see the relevant local information when you return to or reopen our Services after leaving.

 

  • Sign-in and authentication: When you sign in to our site using your personal account, we store a unique ID number, and the time you signed in, in an encrypted Cookie on your device. This Cookie allows you to move from page to page within the site without having to sign in again on each page. You can also save your sign-in information so you do not have to sign in each time you return to the site.

 

  • Security: We use Cookies to process information that helps us secure our software, as well as detect fraud and abuse.

 

  • Storing certain information you provide to improve user experience: We use Cookies to remember information you shared.

You also may adjust your choices by clicking “Manage Cookies” in the footer of the website or through the settings made available on the website. Certain features of our products and Services depend on Cookies. If you choose to block Cookies, you cannot sign in or use some of those features, and preferences that are dependent on Cookies will be lost. If you choose to delete Cookies, any settings and preferences controlled by those Cookies, including advertising preferences, are deleted and will need to be recreated.

 

Most mobile devices and applications allow you to manage how similar technologies, such as unique identifiers used to identify an app or device, are set and used.

 

  1. How We Use Information and the Legal Basis for Processing Information

 

The purpose of collecting Personal Data is to provide you with products and/or Services, and to ensure that we comply with applicable laws, regulations and other regulatory requirements. This involves:

 

  • Operating, providing, maintaining and developing our Services to you, including registration, activation, verification, Smart Device discovery and control, error report, user feedback.

 

  • Implementing and maintaining security safeguards for the purpose of preventing loss and fraud, including verifying user identity or purchase order status. We will use such information only when it is necessary and in accordance with our legitimate interests to protect users and Services.

 

  • Customer support services which include answering customer inquiries and dealing with malfunction issues, sending system and app notifications.

 

  • Sending APP notifications or emailswhere you have provided your consent or based on our contract with you and/or our legitimate interests.

 

  • Storing and maintaining information related to you for our business operations or for fulfilling our legal obligations.

 

The legal basis for processing Personal Data under this Policy in accordance with GDPR includes the following:

 

  • Obtaining your consent: You can provide Personal Data to us on a voluntary basis for the purposes of providing you with our Services.

 

  • Performing our contract with you according to our User Agreement. When you create an account, register or access our Services, the purposes of processing your Personal Data are primarily determined by that service and we will process your Personal Data to manage and operate our business and provide our Services.

 

  • Complyingwith our legal obligation.

 

  • Protectingyour and other individuals’ vital interests.

 

  • Processing based on legitimate interests (e.g., security, service functionality), unless overridden by your fundamental rights.

  • Using “Try It Now Mode” to use eWeLink Services

 

We process your mobile device information, User Data, log data, location information, Wi-Fi and Bluetooth information, and Smart Device data to help you connect and control Smart Devices under the Try It Now Mode. The legal basis for this processing is to perform our contract with you according to our User Agreement.

 

  • Creating and maintaining your eWeLink account

 

Personal Data collected when you create an eWeLink account on our websites or through our mobile devices is used to create the personal account and profile page for you. The legal basis for this processing is to perform our contract with you according to our User Agreement.

 

  • Processing your purchase order

 

Information related to purchase orders (including purchase of our subscription plan or other paid services) is used for processing such orders. The order number, the total of your payment amounts, payment time, service period will be used to check and confirm the order and provide related services accordingly. The legal basis for this processing is to perform our contract with you according to our User Agreement.

 

  • Use of Smart Devices

 

We process your account data, mobile device information, User Data, log data, location information, Wi-Fi and Bluetooth information, and Smart Device data to help you connect and control Smart Devices through eWeLink. The legal basis for this processing is to perform our contract with you according to our User Agreement. Where separately indicated, the processing is based on your consent.

 

  • UsingAI tools to control Smart Devices

 

You can collaborate with AI tools via the eWeLink MCP Server to enable AI tools to issue commands and configure scenario-based interactions for Smart Devices managed under your eWeLink accounts. When you enable, authorize and use this function, we may use your data of Smart Device control scenarios and information related to Smart Devices, and transmit them to your selected AI tools so that you can check the Smart Devices’ status and control them through AI tools. The legal basis for this processing is based on your consent.

 

  • Personalized services

 

When we are handling your account, profile data, usage data, and Smart Device information, we aim to provide individualized product design and service tailored to your request, including recommending or showing products and ads that may interest you, and inviting you to take surveys about product usage. We may use profiling functions for analysis which may also be related to and supported by our manual methods. We do not use complete automated decision-making in our Services to process your Personal Data.

 

  • Providing push notifications and email communications

 

To provide and support our Services, we may send you in-app push notifications and emails for Service-related notifications and updates, and—where you have provided your consent—for offers and subscription-related updates. Specifically:

 

  • Service-related notifications and updates

 

These communications are necessary to operate, maintain, and improve our Services, and may include:

 

  • Device status notifications (such as on/off status);

 

  • Device alerts and security-related notifications;

 

  • Updates to products or features;

 

  • Important service announcements or major events.

 

Such Service-related notifications and updates are not marketing communications, which will be sent to perform our contract with you or based on our legitimate interests in ensuring the proper functioning, security, and reliability of our Services.

 

  • Offers and subscription-related updates

 

Where you have provided your consent, we may send you communications related to our subscription services, which may include:

 

  • Subscription plan options or offers;

 

  • Discounts, trials, or savings opportunities related to subscriptions.

 

Offers and subscription-related updates are considered marketing communications under applicable data protection laws and will only be sent where the required consent has been obtained.

 

Meanwhile, you can manage push notifications or opt out of receiving marketing emails at any time:

 

  • For marketing emails, by deselecting the relevant option during account registration, or clicking the “unsubscribe” link included in any marketing email you receive. Opting out of marketing emails does not affect your ability to receive service-related notifications and updates.

 

  • For push notifications, by adjusting your preferences in theauthorization management section of the APP’s Profile or Settings section, or changing notification permissions through your mobile device’s operating system settings. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

 

To deliver the above communications, we may process your Personal Data, including account information (i.e. your email address), application-related information (i.e. APP version ID and package name), mobile device information (i.e. device model and brand), communication preference and consent settings.

 

  • Live chat with our support teams

 

We will use your nickname, email address, contents of the chat to provide live chat services, protect the security of the chat and provide feedback on and improvement of our Services. We will also use the diagnostic information about your Smart Devices to fulfill your requests and provide support. The legal basis for this processing is to perform our contract with you according to our User Agreement.

 

  1. To Whom We Share Information

 

We share your Personal Data with your consent or as necessary to provide any products and/or Services you have requested or authorized. We may share your Personal Data with the following third parties:

 

  • You and, where appropriate, your appointed representatives.

 

  • Trusted third-party service providers who provide us with certain business-related services, including website hosting, data analysis, payment and credit card processing, infrastructure supply, IT services, customer support services, email sending services, AI toolsand other similar services so that they can provide services to us. Where they process Personal Data based on our instructions, they shall comply with our Privacy Policy and any other appropriate confidentiality and security measures.

 

  • Independent datacontrollers who provide Smart Devices or related services.

 

  • Independent advisors: We may disclose Personal Data to our independent advisors such as accountants, auditors, consultants, lawyers, and other outside professional advisors, subject to binding contractual or statutory obligations or statutory confidentiality obligations.

 

  • As required by law, we may disclose Personal Data to third parties, such as law enforcement agencies, regulators, other authorities and other third parties for legal reasons where required by applicable laws or in response to valid legal requests:

 

  • In connection with the establishment, exercise, or defense of legal claims.

 

  • To comply with laws or to respond to lawful requests and legal process.

 

  • To protect our rights and property and the rights, personal safety and property of others, including to enforce our agreements and policies.

 

  • To detect, suppress, or prevent fraud or other criminal activity.

 

  • As otherwise required by applicable law.

 

  • In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposals of all or part of our business, assets, or stocks (including but not limited to the above circumstances related to any bankruptcy or similar proceedings), we shall disclose your Personal Data to other third parties. In this case, you will receive a clear notification via anemail and/or our website regarding the change of data controller, where required by law, the incompatibility of the new use of your Personal Data, and the choice of Personal Data.

Except for the third parties mentioned above, we only disclose your Personal Data to other third parties with your consent.

 

  1. How your Personal Data is transferred globally

 

Because of the international nature of our business, we transfer Personal Data within the CoolKit group, and to third parties as noted above, in connection with the purposes set out in this Policy. For this reason, we transfer Personal Data to other countries that may have different laws and data protection compliance requirements than those that apply in the country in which you are located, including [China and the European Union]. However, this does not change our commitment to comply with this Policy and to protect your Personal Data.

 

In the event of a transfer by us, we ensure that international transfers of your Personal Data are made pursuant to appropriate safeguards by relying on:

 

  • Adequacy decisions under Article 45 of GDPR. These decisions are made by the European Commissionwhere some countries are recognized as offering an adequate level of data protection. The current adequacy decisions can be found here; or

 

  • The necessity for performing the contract with you or your interest. Inthe absence of an adequacy decision, we may rely on Article 49 (1)(b) and (c) of GDPR to transfer your Personal Data to countries without an adequacy decision when necessary to provide our necessary Services and APP’s basic functions; or

 

  • Standard contractual c The transfer may also be made pursuant to appropriate safeguards, such as standard contractual clauses adopted by the European Commission in connection with appropriate supplementary measures.   1. Retaining Period for Your Information

 

We have taken measures to ensure that your information is only processed for the minimum period necessary for the purposes set out in this Policy. The criteria for determining the duration for which we will retain your information are as follows:

 

  • We maintain an ongoing service as long as your account remains active or as required to provide the service.

 

  • Your information is necessary in connection with the lawful purposes set out in this Policy, for which we have a valid legal basis.

 

  • Any statutory retention periods as required by the law of the applicable region, for example, the European Union.

 

  • If any relevant legal claims are brought, we continue to process your relevant information for such additional periods as are necessary in connection with that claim.

 

Once the periods above, each to the extent applicable, have concluded, we will securely delete or anonymize in accordance with applicable standards.

 

Under the Try It Now Mode, once you quit the mode, we will delete your temporary data instantly and permanently.

 

  1. Your Data Protection Rights

 

According to applicable laws, you have the following rights regarding the processing of your Personal Data:

 

  • The right to request access to, or copies of, your Personal Data, together with additional information.

 

  • The right to request rectification of any inaccuracies or incompleteness in your Personal Data.

 

  • The right to request, on legitimate grounds, restriction of processing of your Personal Data.

 

  • The right to have certain Personal Data transferred to another data controller, in a structured, commonly used and machine-readable format, if applicable.

 

  • The right to request the deletion or removal of your Personal Data where there is no other legal basis for us to keep using it. Please note that we may not be able to immediately remove the information from the backup system due to applicable laws and regulations or technological limitations. If this is the case, we will isolate and exclude your Personal Data from any further processing until the backup can be deleted or anonymized/deidentified.

 

You can also delete your eWeLink account by clicking Profile > Settings > eWeLink Account > Delete Account. Please note that once you confirm account deletion, your account will be permanently removed and cannot be restored.

 

  • The right to object to the processing of your Personal Data by us or on our behalf, where such processing is based on 6(1)(f) (legitimate interests) of GDPR. You may also object to the processing of your Personal Data for direct marketing purposes.

 

  • The right to lodge complaints regarding the processing of your Personal Data with a competent Data Protection Authority. However, we encourage you to first contact us so that we can together solve any concerns you may have.

 

  • Where the use of your Personal Data is based on your consent, you have the right to withdraw that consent at any time, but the withdrawal of consent does not affect the legality of data processing based on consent before the withdrawal.

 

You can exercise one or more of these rights or ask a question about these rights by using the contact details provided in “How to Contact Us”.

 

In some cases, it will be necessary to provide evidence of your identity before we can give effect to these rights. When your request requires the establishment of additional facts, we will investigate your request reasonably and promptly, before deciding what action to take.

 

  1. Information Security Measures

 

We are committed to ensuring the security of your Personal Data. In order to prevent unauthorized access, disclosure, or other similar risks, we have established reasonable physical, electronic, and management procedures to protect the information we collect. In order to protect the security of your Personal Data, we have set out the following security procedures and technical and organizational measures:

 

  • Your Personal Data will be stored on secure servers and protected in controlled facilities.

 

  • All data stored in the backend will be categorized into different levels according to the importance and sensitivity of the data, for example, whether it contains Personal Data.

 

  • In the data center, data clusters containing sensitive data are assembled in the network topology and placed in rooms with additional physical security protection.

 

  • The data exchange between the eWeLink device and the server is encrypted by the Secure Socket Layer (SSL).

 

  • We regularly review our practices regarding the collection, storage, and processing of information, including physical security measures, in order to prevent unauthorized access to the system.

 

  • The system is only accessible to eWeLink employees and trusted third-party service providers specified in this Policy so that they can obtain the required information for processing data. They must abide by strict contractual confidentiality obligations. If they fail to fulfill these obligations, they may face punishment or dismissal.

 

  • All server clusters used for cloud platform data storage and processing are set up with access control.

 

Please note that to implement the above-mentioned arrangements, eWeLink may process or back up your data using the infrastructure it operates and controls. Currently, eWeLink has designated the deployment of data centers and distributed data nodes on Amazon AWS infrastructure in Frankfurt (Germany), California (USA), Singapore, and Beijing (China). As such, your Personal Ddata may be stored in or accessed from these facilities, depending on service availability, technical requirements, and applicable legal or regulatory obligations.
